Yrkestrafikkforbundet has submitted a consultation response to proposals for amendments to the National Insurance Act and the Working Environment Act regarding the obligations of those on sick leave. The union supports the goal of earlier follow-up and a faster return to work.
At the same time, I believe YTF that the proposal results in an unbalanced distribution of responsibilities, where the employee's duties are clarified, while the employer's obligation to facilitate is less specified.
YTF is particularly concerned about how the duty to provide information and take action can be put into practice. Requirements for early information and assessment of work ability may be too strict, especially if the health condition changes.
The union also warns against proposals for an obligation to perform work other than that agreed upon. In many businesses, there are no real alternative tasks, and employees risk being considered uncooperative without the employer being able to offer accommodations.
YTF emphasizes that a lack of accommodation options must not affect employees, and points to the need for real solutions that make it possible to remain at work, even with reduced work capacity.
