The proposed amendments to Section 23 of the Road Traffic Act and the Regulations on the Use of Vehicles concern the introduction of additional liability for transport companies for securing cargo. The purpose is to clarify the responsibilities of transport companies and regulate matters that are currently largely handled through practice.
Yrkestrafikkforbundet are positive about the proposal. The association points out that inadequate cargo securing can have serious consequences, and that the causes of such incidents are often complex. YTF points out that matters related to cargo securing are not exclusively about the driver's actions.
The consultation response points out YTF that risks in cargo securing can be due to insufficient information about the nature of the goods, insufficient or incorrect securing equipment, and unclear responsibilities in the transport chain. The association believes that the transport company must obtain the necessary information before undertaking the transport assignment, and pass this on to the driver.
YTF supports the proposal for guidance and documentation obligations for high-risk transports. The association emphasizes that the list of such transports must not be understood as exhaustive, and points out that known risk factors such as liquid spills from fish transport should also be included.
In conclusion, supports YTF that minor violations can be sanctioned with a fine, while more serious violations can be met with corporate penalties, in line with the proposal in the consultation.
